DaySpring Cards, Inc. (“DS”) is encouraging others to spread joy through a video/photograph contest on Instagram with Sadie Robertson’s “Live Original” greeting card line. In an effort to build others up, DS is sponsoring the Sadie Robertson Live Original Instagram video/photograph contest (“Contest”). This contest is governed by these official contest rules (“Official Rules”). By participating in the contest, each contestant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by DS and its agents, are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed, administered by or associated with Instagram. Any questions, comments or complaints regarding the promotion must be directed to DS and not Instagram.
Eligibility: Contest is open to: (1) all legal residents of the fifty (50) United States and the District of Columbia where not prohibited by law; (2) any individual that is thirteen (13) years of age or older at the time of entry; (3) any individual who is not an employee of DS, their respective advertising and promotional agencies, the independent judging organization (if any), or any family member living with any such employee; and, (4) any individual who follows the Official Rules as provided herein. DS reserves the right to verify the eligibility of each entrant.
Contest Period: The contest begins at 5:00 pm April 10, 2015 CDT and ends at 11:00 pm June 7, 2015 CDT (“Contest Period”). All video/photograph entries (submissions) must be received on or before the time stated during the Contest Period. DS is not responsible for entries that become lost or misdirected. DS reserves the right to extend or shorten the contest at their sole discretion.
How to enter: Each Friday night during the Contest Period, Sadie Robertson will post a video on her Instagram account, @legitsadierob, explaining that week’s Instagram video/photograph challenge. Each video or photo submission represents one (1) entry into the contest. All entries must be submitted electronically through Instagram and include the hashtags #liveoriginal and #liveoriginalgiveaway. Submissions are not to exceed 15 seconds (00:00:15). There is no mail-in method of entry.
Each video must be an original, must be produced by the entrant and shall not have been published elsewhere or won another video/photo competition. By entering the contest, the entrant represents, acknowledges and warrants: that the submitted video/photo is an original work created solely by the entrant; that the submitted video does not infringe on the copyrights, trademarks, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity; and, that no other person or entity has any right, title, claim or interest in the submitted video/photograph.
Any and all submitted videos/photographs must not contain obscene, provocative, defamatory, sexually explicit, or otherwise objectionable or inappropriate content. Videos and images deemed inappropriate by DS will be disqualified.
Video criteria: Contestants will reference the distinct challenge announced each week by Sadie Robertson on her Instagram account, @legitsadierob. Submissions not meeting that week’s criteria shall be disqualified. Additionally, DS reserves the right to disqualify submissions for any other reason in its sole discretion.
Contest Prizes: There will be up (75) weekly winners selected from the videos/photographs submitted by entrants (‘Winner”) each week, commencing April 10, 2015, through June 7, 2015. Winners are solely responsible for all other fees, taxes, expenses and costs.
Winner Selection: Announcements and instructions for each prize will be posted to the contest microsite www.liveoriginalgiveaway.com. Each entrant is responsible for monitoring his/her Instagram account and the DaySpring Instagram account, @dayspringcardscards, for prize notification and receipt or other communications related to this contest. If a potential prize Winner cannot be reached by Administrator (or DS) before 11:59 pm on June 8, 2015 CST, using the contact information provided on Instagram, or if the prize is returned as undeliverable, that potential prize Winner shall forfeit the prize and another Winner will be randomly selected as set out herein.
By entering this Contest, Winners agree that their names and winning Submission can be announced on Instagram after they have been notified of their winning entry. Winners will be chosen based on eligible content and submission timeframe. By entering this Contest, Winners agree that their names and winning Submission can be announced on @legitsadierob and @dayspringcards on Instagram, www.liveoriginalgiveaway.com, and www.DaySpring.com. Upon the request of DS, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential Winner fails to comply with these official rules, that potential Winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received. DS reserves the right to select fewer than six hundred (600) potential Winners if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.
Prizes must be accepted as awarded. Prizes are non-transferable and non-redeemable for cash. Prizes may not be exactly as shown in promotional materials. In case of unavailability of any Prize or for any other reason, in DSs sole discretion, DS reserves the right to substitute a Prize of equal or greater value.
Additional Limitations: Odds of winning a prize depend on the number of eligible Submissions received. By participating and submitting a video, each entrant hereby grants permission for their entry to be posted on www.DaySpring.com, @legitsadierob and @dayspringcards on Instagram, and www.liveoriginalgiveaway.com. Entrants agree that Submissions can be used in whole or in part by DS in any media whatsoever, including but not limited to marketing, advertising, promotional activities or materials, or on websites, with no fee, remuneration, credit, or any compensation whatsoever. Each entrant agrees that DS is not responsible for any unauthorized use of Submissions by third parties. Submissions will not be returned and will become the property of DS. DS is not responsible for errors in the offer or administration of this Contest, including but not limited to, errors in the advertising, the Contest rules, the selection, notification and announcement of the Winners or the distribution of the Prizes. DS is not responsible for lost, late, illegible, incomplete, mutilated or misdirected Contest Submissions. Personal information collected from entrants will be used by DS for the purpose of administering this Contest. DS will not sell, share, use or otherwise disclose the personal information of entrants with third parties, other than to third parties engaged by them to fulfill the above purposes, without consent, or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of their personal information for the purposes of administering the Contest. DS reserve the right, in its sole discretion, to terminate the Contest, in whole or in part, and/or modify, amend or suspend the Contest, and/or the Contest rules in any way, at any time, for any reason without prior notice.
INDEMNIFICATION AND LIMITATION OF LIABILITY: BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS DS AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE INSTAGRAM PLATFORM, SADIE ROBERTSON AND LIVE ORIGINAL, THEIR ADMINISTRATOR(S), ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. DS AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE. DS AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS DISCLAIM ANY LIABILITY FOR DAMAGE TO ANY COMPUTER SYSTEM RESULTING FROM ACCESS TO OR THE DOWNLOAD OF INFORMATION OR MATERIALS CONNECTED WITH THE CONTEST.
